At zYpper, we take privacy very seriously and it is always our goal to communicate with our supporters in the most efficient and effective way while also protecting the sensitive personal information we collect. zYpper is the sole owner of the information collected on the zYpper Website. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. We may also collect Personal Information about you when you interact with us on social media sites and from other third parties and may also automatically collect information that may contain Personal Information as described in zYpper's Cookie Policy.  We may use that Personal Information where in our legitimate interest to do so for the following purposes:

A) Account Information 

In order to purchase products from the Website, a user must first complete the registration form. During registration a user is required to give their contact information (such as name and email address). This information is used to contact the user about the products on our site for which they have expressed interest.

B) Payment Information

We require information from the user on our order form in order to process any purchases using a third-party partner. Here a user must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill the customer’s orders. If we have trouble processing an order, this contact information is used to get in touch with the user.

C) Third Party Collections

We use Third Parties to collect and store our Account and Payment Information in accordance with this Privacy Policy as well as other information related to volunteer work and customer service.

  1. Enwid (this is the platforms that technically collects and stores the information for all transactions through our checkout page)

  2. Stripe (this are the app that we use to collect the credit card information. It is accessed through Enwid but it technically is not Enwid)

  3. MailChimp (this is the platform that collects name and email address for marketing on-site through MailChimp forms)

  4. Formstack (this is the platform that we use to collect and house information for people who want to do cleanups both domestically and abroad)

  5. CookieBot (this is the app that we use to allow users in the EU who use our website, to fully manage their data including Erasure Rights)

  6. Givingloop (this are the app that we use to collect the credit card information for donations. It is accessed through Enwid but it technically is not Enwid)

 

D) Cookies

A cookie is a piece of data stored on the user’s hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our site. Once the user closes their browser, the cookie simply terminates. For instance, by setting a cookie on our site, the user would not have to log in a password more than once, thereby saving time while on our site. If a user rejects the cookie, they may still use our

site. The only drawback to this is that the user will be limited in some areas of our site. Cookies can also enable us to track and target the interests of our users to enhance the experience on our site. Some of our business partners use cookies on our site (for example, advertisers). However, we have no access to or control over these cookies. For personal data subject to the European Union’s General Data Protection Regulation (“GDPR”), we rely on several legal bases to process the data. These include when you have given your consent, which you may withdraw at any time using your account settings; when the processing is necessary to perform a contract with you, like the Terms of Service; and our legitimate business interests, such as in improving, personalizing, and developing the Services, marketing new features or products that may be of interest, and promoting safety and security as in this Privacy Policy.

 

E) Log Files

We use IP addresses to analyze trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

We will share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can identify any individual person. We use an outside orders and a credit card processing company to bill users for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes. We partner with third parties, such as Enwid, Stripe, CookieBot, MailChimp, Formstack and Givingloop to provide specific services. When the user signs up for these services, we will share names, or other contact information that is necessary for the third party to provide these services. These parties are not allowed to use personally identifiable information except for the purpose of providing these services. We may also share your information for legal reasons or to prevent harm. We may preserve or disclose information about you to comply with a law, regulation, legal process, or governmental request; to assert legal rights or defend against legal claims; or to prevent, detect, or investigate illegal activity, fraud, abuse, violations of our terms, or threats to the security of the Services. If we are involved in a merger, acquisition, or sale of assets, we will continue to take measures to protect the confidentiality of personal information and give affected users notice before transferring any personal information to a new entity.

A) Links

This web site contains links to other sites. Please be aware that we (zYpper) are not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every web site that collects personally identifiable information. B) Newsletter

If a user wishes to subscribe to our newsletter, we ask for contact information such as name and email address.

 

C) Surveys & Contests

From time-to-time our site requests information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name, email address and/or shipping address), and demographic information (such as zip code, gender or age level). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site.

D) Tell-A-Friend

If a user elects to use our referral service for informing a friend about our site, we ask them for the friend’s name and email address. zYpper will automatically send the friend a one-time email inviting them to visit the site. zYpper stores this information for the sole purpose of sending this one-time email. The friend may contact us at info@zYpper.si to request the removal of this information from our database.

E) Security

This website takes every precaution to protect our users’ information. When users submit sensitive information via the website, your information is protected both online and off-line. When our registration/order form asks users to enter sensitive information (such as credit card number and/or social security number), that information is encrypted and is protected with the best encryption software in the industry - SSL. While on a secure page, such as our order form, the lock icon on the bottom of Web browsers such as Google Chrome and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when you are just ‘surfing’. All of our users’ information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information. Our employees must use password-protected screen-savers when they leave their desk. When they return, they must re-enter their password to re-gain access to your information. Furthermore, ALL employees are kept up-to-date on our security and privacy practices. Every quarter, as well as any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our customers’ information is protected.

We also send the user site and service announcement updates. Users are not able to un-subscribe from service announcements, which contain important information about the service. We communicate with the user to provide requested services and in regard to issues relating to their account via email or phone.

5. How You Can Correct Any Inaccuracies in the Information.

We give you access and control of your personal data as described in this Privacy Policy. If you live

in the European Economic Area, United Kingdom, and Switzerland (the “Designated Countries”), you

We will retain your data for a period of 6 months from the time we first collect your data if you have no additional activity or until you opt out, whichever comes first. 

 

A) Policies for Children

In order to respect the privacy of minors, zYpper does not knowingly collect, maintain or process Personal Information submitted online via our Internet Services by anyone under the age of 18. To the extent zYpper collects Personal Information on minors in the context of one of the purposes mentioned in the Statement, 4ocean will only do so with the appropriate consent or as otherwise permitted under applicable laws.

 

B) Your California Privacy Rights

Under California Civil Code Section 1798.83, California customers are entitled to request information relating to whether a business has disclosed Personal Information to any third parties for the third parties’ direct marketing purposes. zYpper does not sell or share your Personal Information with third-party companies for their direct marketing purposes without your consent.

 

C) International Data Transfers

We will rely on multiple legal bases to lawfully transfer personal data around the world. These include your consent, the EU-US and Swiss-US Privacy Shield, and EU Commission approved model contractual clauses, which require certain privacy and security protections. You may obtain copies of the model contractual clauses by contacting us. 4ocean complies with the Privacy Shield principles regarding the collection, use, sharing, and retention of personal information as described in our Privacy Shield certifications. zYpper is subject to the oversight of the Ministry of the Interior of Republic of Slovenia and remains responsible for personal information that we transfer to others who process it on our behalf as described in the How Information Is Shared section. TERMS OF USE

1. Introduction 

A) This document outlines the Acceptable Use Policy (Use Policy) under which you, the user (You) may access the content and functionality of the website accessible at www.zYpper.si (the “Website”).

B) The Website provides information concerning Development of Music and Social Cultures zYpper's (“zYpper”) products and mission. The Website allows its users to provide personal data, including but not limited, to personal information, including name, physical address, e-mail address, and telephone number. All items purchased from zYpper are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to You upon our delivery to the carrier.

10. Returns, Refunds, and Title 

zYpper does not take title to returned items until the item arrives at our fulfillment center. A refund may be issued without requiring a return, solely at our discretion. In this event, zYpper does not take title to the refunded item. For more information about our returns and refunds, please see our Returns Policy.

11. Product Descriptions 

zYpper attempts to be as accurate as possible. However, 4ocean does not warrant that product descriptions or other content or Website material is accurate, complete, reliable, current, or error-free. If a product offered by zYpper itself is not as described, your sole remedy is to return it in unused condition and our entire liability is to refund the price you paid for the returned item.

12. Pricing 

zYpper cannot confirm the price of an item until You order. Despite our efforts, a small number of the items in our catalog may be mispriced. If the correct price of an item sold by zYpper is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify You of such cancellation. RETURN POLICY

At zYpper, customer satisfaction is always our top priority. Our dedicated Quality Control and Quality Assurance Teams will inspect your items prior to shipping. Our product quality is guaranteed. However, you do need to be carefully and accurately check your size before buying. Please kindly refer to the size charts on the product page. 1. 30 Day Returns Warranty
Customers can contact us within 30 days of receiving the item. If you have received a defective or damaged item, the wrong size or the wrong product, please contact us immediately.

2. How to Reach Us
Contact us and describe the issue in detail, including the return reason, along with your order number and product name. For defective, incorrect, or not as described item, please send us a clear picture or video of the problem.

3. Our Solutions:
A) zYpper's Responsibility:
If our company is responsible for the issue, we will allow a return to our warehouse for a refund. Once we receive the item, we will refund in full the original product price and its shipping or resend for free a replacement at our expense. This solution is only when zYpper is responsible for shipping the wrong item/size.
B). Customer's Responsibility

4. Incorrect Order (size of the item)
If the customer has ordered an incorrect size or product, we can also allow a return. In this case, the customer will be responsible for the shipping fee both ways (to and from our warehouse) for an exchange. If the customer chooses a refund, we will refund the original product price. All and any shipping fees are non-refundable. Please notice we have added the shipping fee on the product price, so the shipping fee for reshipping or refunded items amount would not be the same as your purchase.

5. Unwanted Item
If the customer decides that they no longer want the item, they can report this to us within 3 days of receiving the product.

6. Didn't Receive Items
If the tracking says delivered, and you don't receive the package, please check at your mailbox, front door, or any other places the package would be. Otherwise, you will have to report losses to the post office or police station. SheShow is not liable for lost or stolen packages. If the package was undelivered because of incorrect/ incomplete address, unclaimed, or refused, you are responsible for the original and return shipping costs, as well as any duties, taxes, and/or customs charges that may be incurred on the package on the original and return shipments. The amount of these charges will be subtracted from your merchandise refund. In some cases, your package may be abandoned and no refund will be issued for the refused package. 

 

7. Reship a refused or undeliverable package 

The new shipping costs depend on which new shipping method you choose. Packages to America don't support to reship.


8. Satisfaction Guarantee
Your satisfaction is our priority! zYpper temporary policy: If you are dissatisfied with your order, please contact us within 30 days of receiving the product.

9. Additional notes about Warranty
All returns must first be approved by our customer service team; if approved, you will be provided with an RMA form. Returned items without an RMA form will not be accepted. All returned items must be in brand new condition, unused/unworn, unwashed, come with all original tags and their original packaging. If the customer requests a refund, we will refund the original product cost upon receiving the returned item. All shipping fees to return the item, and the original shipping fees, are non-refundable. We do not accept returns on swimwear, and discounted items, unless a customer received a wrong item or the item was faulty.

For returned items, we will need 3-6 business days upon receiving your item(s) to process the solution. After this time, the refund time-frame is as below: Paypal account refunds: Up to 48 hours Credit card refunds: Between 3-7 business days

SHIPPING POLICY

1. Delivery charges?

Delivery charge varies with each country. Delivery incur relatively higher shipping costs on low value items. In such cases, charging a nominal delivery charge helps them offset logistics costs. Please check your order summary to understand the delivery charges for individual products.

2. Date is not correspond to the delivery timeline

It is possible that the delivery courier have a holiday between the day your placed your order and the date of delivery, which is based on the timelines shown on the product page. In this case, we add a day to the estimated date. Some courier partners and Sellers do not work on Sundays and this is factored in to the delivery dates.

3. Estimated delivery time?

zYpper generally procure and ship the items within the time specified on the product page. Business days exclude public holidays and Sundays. Estimated delivery time depends on the following factors:

  • The zYpper offering the product

  • Product's availability with the Seller 

  • The destination to which you want the order shipped to

 

4. Hidden costs (sales tax, octroi etc)

There are NO hidden charges when you make a purchase on zYpper. List prices are final and all-inclusive. The price you see on the product page is exactly what you would pay. Delivery charges are not hidden charges and are charged (if at all) extra depending on the zYpper's shipping policy. The price may include the amount of customs duty if charged by the recipient country. The amount of customs duty is included in the set on the part of the recipient if it is charged by the recipient's country.

5. Vary estimated delivery time

You have probably noticed varying estimated delivery times for zYpper product you are interested in. Delivery times are influenced by product availability, geographic location of the Seller, your shipping destination and the courier partner's time-to-deliver in your location.

7. Available

zYpper might not have the item in stock but can procure it when an order is placed for the item. The delivery time will depend on the estimated procurement time and the estimated shipping time to your location. It also applies to unique products that determine the manufacturing time in the included multi-bit complications.

8. Preorder or Forthcoming

Such items are expected to be released soon and can be pre-booked for you. The item will be shipped to you on the day of it's official release launch and will reach you in 10 to 14 business days. The Preorder duration varies from item to item. Once known, release time and date is mentioned. (Eg. 5th May, August 3rd week)

9. Out of Stock

Currently, the item is not available for sale. Use the 'Notify Me' feature to know once it is available for purchase.

10. Back In Stock Soon

The item is popular and is sold out. You can however 'book' an order for the product and it will be shipped according to the timelines mentioned by the Seller.

11. Temporarily Unavailable

1. Pay for a zYpper purchase?

zYpper offers you multiple payment methods. Whatever your online mode of payment, you can rest assured that zYpper's trusted payment gateway partners use secure encryption technology to keep your transaction details confidential at all times. zYpper accepts payments made using Visa, MasterCard, Maestro and American Express credit/debit cards all over the globe.

2. Hidden charges on zYpper

There are NO hidden charges when you make a purchase on zYpper. The prices listed for all the items are final and all-inclusive. The price you see on the product page is exactly what you pay. Delivery charges may be extra depending by the country we deliver.

A) Credit cards

We accept payments made using Visa, MasterCard and American Express credit cards. To pay using your credit card at checkout, you will need your card number, expiry date, three-digit CVV number (found on the backside of your card). After entering these details, you will be redirected to the bank's page for entering the online 3D Secure password.

B) Debit cards

We accept payments made using Visa, MasterCard and Maestro debit cards. To pay using your debit card at checkout, you will need your card number, expiry date (optional for Maestro cards), three-digit CVV number (optional for Maestro cards). You will then be redirected to your bank's secure page for entering your online password (issued by your bank) to complete the payment.

4. Safe use of my credit/debit cards

Your online transaction on zYpper is secure with the highest levels of transaction security currently available on the Internet. We are using Stripe platform for secure transations. Stripe uses 256-bit encryption technology to protect your card information while securely transmitting it to the respective banks for payment processing. All credit card and debit card payments on zYpper web page are processed through secure and trusted payment gateways managed by leading Stripe paltform. Stripe now use the 3D Secure password service for online transactions, providing an additional layer of security through identity verification.

5. Pevent card fraud

zYpper realizes the importance of a strong fraud detection and resolution capability. We and our online payments partners monitor transactions continuously for suspicious activity and flag potentially fraudulent transactions for manual verification by our team. In the rarest of rare cases, when our team is unable to rule out the possibility of fraud categorically, the transaction is kept on hold, and the customer is requested to provide identity documents. The ID documents help us ensure that the purchases were indeed made by a genuine card holder. We apologise for any inconvenience that may be caused to customers and request them to bear with us in the larger interest of ensuring a safe and secure environment for online transactions.

6. 3D Secure password

The 3D Secure password is implemented by VISA and MasterCard in partnership with card issuing banks under the "Verified by VISA" and "Mastercard SecureCode" services, respectively. The 3D Secure password adds an additional layer of security through identity verification for your online credit/debit card transactions. This password, which is created by you, is known only to you. This ensures that only you can use your card for online purchases.
